      <p>It is an offence for a product to be made available for public sale from five <?L 1-3?>years after the day on which this Act is passed if it—</p>
     </intro>
     <level GUID="_03661124-939e-4cd5-8466-b10ef045b4d7" class="para1" eId="sec_1__subsec_1__para_a">
      <num><?L 1-4?>(a)</num>
      <content>
       <p>is a cosmetic product, a personal care product, or a treated article, and</p>
      </content>
     </level>

      <num><?L 1-5?>(b)</num>
      <content>
       <p>contains biocides</p>
      </content>

    </subsection>

     <num><?L 1-7?>(2)</num>
     <content>
      <p>A person who commits an offence under <mref><ref class="valid" href="#sec_1" ukl:targetGuid="_47981da8-b699-4eca-9e05-a9c88bd3c70a">section 1</ref><ref class="valid" href="#sec_1__subsec_1" ukl:targetGuid="_d34cadde-2e58-496b-919c-157e59029e90">(1)</ref></mref> is liable, on summary <?L 1-8?>conviction, to a fine not exceeding level 5 on the standard scale.</p>
     </content>
    </subsection>

     <num><?L 1-9?>(3)</num>

      <p>Where an offence under this Part has been committed by a body corporate <?L 1-10?>and it is proved that the offence—</p>
     </intro>
     <level GUID="_fdec0f65-dba6-45e9-ac7e-fbade8800f73" class="para1" eId="sec_1__subsec_3__para_a">
      <num><?L 1-11?>(a)</num>
      <content>
       <p>has been committed with the consent or connivance of a person falling <?L 1-12?>within <ref class="valid" href="#sec_1__subsec_4" ukl:targetGuid="_9c3ef59f-d04f-4f3a-a6a5-9988f40379ec">subsection (4)</ref>, or</p>
      </content>
     </level>
     <level GUID="_54e5f368-9f73-4d2a-8716-630ed42bbd10" class="para1" eId="sec_1__subsec_3__para_b">
      <num><?L 1-13?>(b)</num>
      <content>
       <p>is attributable to any neglect on the part of such a person,</p>
      </content>
     </level>

      <p><?L 1-14?>that person (as well as the body corporate) is guilty of that offence and is <?L 1-15?>liable to be proceeded against and punished accordingly.</p>

     <num><?L 1-16?>(4)</num>

      <p>The persons are—</p>
     </intro>

      <content>
       <p>a director, manager, secretary or other similar officer of the body;</p>
      </content>
     </level>

      <num><?L 1-18?>(b)</num>
      <content>
       <p>any person who was purporting to act in such a capacity.</p>

     <p><?L 2-2?>A product is exempt from section 1 if—</p>
    </intro>

     <num><?L 2-3?>(a)</num>
     <content>
      <p>it is medical in nature,</p>
     </content>
    </level>
    <level GUID="_68cd5484-c975-4547-a575-f25204b282ca" class="para1" eId="sec_2__para_b">
     <num><?L 2-4?>(b)</num>
     <content>
      <p>it is proven to be environmentally safe under real-world conditions, <?L 2-5?>or</p>
     </content>
    </level>
    <level GUID="_fa23cdb6-f044-4aab-9b4f-29c81d161a8a" class="para1" eId="sec_2__para_c">
     <num><?L 2-6?>(c)</num>
     <content>
      <p>the producer can demonstrate that the efficacy of the produce is <?L 2-7?>significantly enhanced by the use of the biocide without undue <?L 2-8?>environmental impact.</p>
     </content>

    <num><?L 2-9?>3</num>
    <heading GUID="_dda4ce6d-e6e4-4f8c-8c59-34b6a8d4e84c" eId="sec_3__hdg">Biocidal Consumer Products Advisory Board</heading>
    <subsection GUID="_7090cde1-9dd3-4f0e-bbc9-870c041daa78" class="prov2" eId="sec_3__subsec_1">
     <num><?L 2-10?>(1)</num>
     <content>
      <p>Within six months of the day on which this Act is passed the Secretary of <?L 2-11?>State must establish a Biocidal Consumer Products Advisory Board (“the <?L 2-12?>Board”).</p>
     </content>
    </subsection>
    <subsection GUID="_37350604-794b-40cd-93b6-c4024ed21e2f" class="prov2" eId="sec_3__subsec_2">
     <num><?L 2-13?>(2)</num>
     <intro GUID="_d62233e6-b0f4-4c35-acee-3b3a984f96ed" eId="sec_3__subsec_2__intro">
      <p>The Board must—</p>
     </intro>
     <level GUID="_1808e8a3-fbd6-4eff-98a4-cd7adf0c9398" class="para1" eId="sec_3__subsec_2__para_a">
      <num><?L 2-14?>(a)</num>
      <content>
       <p>keep under review scientific and social evidence on the use and effect <?L 2-15?>of biocides in consumer products in the United Kingdom, particularly <?L 2-16?>regarding microbiotoxicity and its effects on antimicrobial resistance,</p>
      </content>
     </level>
     <level GUID="_d87dd9d9-a8df-4a28-bc8c-1abb0c624ddc" class="para1" eId="sec_3__subsec_2__para_b">
      <num><?L 2-17?>(b)</num>
      <content>
       <p>give to any one or more Ministers, where either the Board consider it <?L 2-18?>expedient to do so or they are consulted by the Minister or Ministers <?L 2-19?>in question, advice on measures (whether or not involving alteration <?L 2-20?>of the law) which in the opinion of the Council ought to be taken in <?L 2-21?>relation to those biocides,</p>
      </content>
     </level>
     <level GUID="_0e7e0fba-732b-4163-9cbb-2c4c8577a75f" class="para1" eId="sec_3__subsec_2__para_c">
      <num><?L 2-22?>(c)</num>
      <content>
       <p>review, on request from the producer or the Secretary of State, an <?L 2-23?>advertising claim relevant to <ref class="valid" href="#sec_6" ukl:targetGuid="_2d54175f-3963-4c2b-a905-602987c4982c">section 6</ref> (marketing of biocidal products),</p>
      </content>
     </level>
     <level GUID="_c0023b2d-6cef-4b08-9dd7-a2dddcd66116" class="para1" eId="sec_3__subsec_2__para_d">
      <num><?L 2-24?>(d)</num>
      <content>
       <p>consider any matter relating to the use of biocides in relevant consumer <?L 2-25?>products which may be referred to them by any one or more of the <?L 2-26?>Ministers and advise the Minister or Ministers in question thereon, <?L 2-27?>and</p>
      </content>
     </level>

      <num><?L 2-28?>(e)</num>
      <content>
       <p>advise the Secretary of State with respect to any communication <?L 2-29?>referred by him or her to the Board, being a communication relating <?L 2-30?>to the control of any dangerous or otherwise harmful biocide made <?L 2-31?>to the Government by any organisation or authority established by or <?L 2-32?>under any treaty, convention or other agreement or arrangement to <?L 2-33?>which that Government is a party.</p>

     <num><?L 2-35?>(1)</num>
     <intro GUID="_08f86bd3-19f8-4908-a19a-d84dfc1c9f68" eId="sec_4__subsec_1__intro">
      <p>The Secretary of State may by regulations made by statutory instrument <?L 2-36?>prohibit the sale of a biocidal consumer product if it presents a danger on <?L 2-37?>the grounds of—</p>
     </intro>

      <num><?L 2-38?>(a)</num>
      <content>
       <p>microbiotixicity, or</p>
      </content>

      <num><?L 2-39?>(b)</num>
      <content>
       <p>the generation of antimicrobial resistance.</p>

     <num><?L 2-40?>(2)</num>
     <content>
      <p>Regulations issued under <ref class="valid" href="#sec_4__subsec_1" ukl:targetGuid="_2f0d035e-cfba-4c37-87d1-b623ba081e5f">subsection (1)</ref> may, but need not be, based on advice <?L 2-41?>from the Biocidal Consumer Products Advisory Board.</p>

      <p>If the Board does recommend regulations to be made under this section, the <?L 3-2?>Secretary of State must make them within three months of that <?L 3-3?>recommendation being made.</p>

      <p>A statutory instrument containing regulations under this Act may not be <?L 3-5?>made unless a draft of the instrument has been laid before and approved by <?L 3-6?>a resolution of each House of Parliament.</p>

    <heading GUID="_01ea48ed-7817-422e-b196-21b3421d935e" eId="sec_5__hdg">Monitoring the impact of biocides in biocidal consumer products</heading>
    <intro GUID="_15bf6d2c-0e98-4a3f-96cd-d49af1ce4aa0" eId="sec_5__intro">
     <p><?L 3-8?>At least once every two years the Secretary of State must produce and lay <?L 3-9?>before Parliament a report on the impact of biocides in consumer products <?L 3-10?>on—</p>
    </intro>

     <content>
      <p>the natural environment, and</p>
     </content>

     <content>
      <p>human health, in particular antibiotic resistance.</p>

    <heading GUID="_a39722dc-b8bc-4f8b-8afa-deaf074c13de" eId="sec_6__hdg">Marketing of biocidal products</heading>
    <subsection GUID="_026ffb98-56f1-4fbe-bd3c-4e8e7c269cb0" class="prov2" eId="sec_6__subsec_1">
     <num><?L 3-14?>(1)</num>
     <content>
      <p>Subject to <ref class="valid" href="#sec_6__subsec_2" ukl:targetGuid="_9afda5bc-28d8-4c85-be71-5745ef9f75e9">subsection (2)</ref>, from one year after the day on which this Act is <?L 3-15?>passed, it is an offence for the marketing of a consumer product containing <?L 3-16?>biocides to implicitly or explicitly claim that it is more effective than a soap- <?L 3-17?>or alcohol-based sanitiser, unless that claim has been proven to the satisfaction <?L 3-18?>of the Biocidal Consumer Products Advisory Board.</p>
     </content>
    </subsection>
    <subsection GUID="_9afda5bc-28d8-4c85-be71-5745ef9f75e9" class="prov2" eId="sec_6__subsec_2">
     <num><?L 3-19?>(2)</num>
     <content>
      <p>A person who commits an offence under <mref><ref class="valid" href="#sec_6" ukl:targetGuid="_2d54175f-3963-4c2b-a905-602987c4982c">section 6</ref><ref class="valid" href="#sec_6__subsec_1" ukl:targetGuid="_026ffb98-56f1-4fbe-bd3c-4e8e7c269cb0">(1)</ref></mref> is liable, on summary <?L 3-20?>conviction, to a fine not exceeding level 5 on the standard scale.</p>
     </content>
    </subsection>
    <subsection GUID="_984e4e07-a555-46fb-990e-cb41277e76d0" class="prov2" eId="sec_6__subsec_3">
     <num><?L 3-21?>(3)</num>
     <intro GUID="_8c545ded-a3e2-4e34-bd4a-6b32b0f48199" eId="sec_6__subsec_3__intro">
      <p>Where an offence under this Part has been committed by a body corporate <?L 3-22?>and it is proved that the offence—</p>
     </intro>
     <level GUID="_a4cdeb52-bd7e-477a-a51d-f0493b846ae0" class="para1" eId="sec_6__subsec_3__para_a">
      <num><?L 3-23?>(a)</num>
      <content>
       <p>has been committed with the consent or connivance of a person falling <?L 3-24?>within <ref class="valid" href="#sec_6__subsec_4" ukl:targetGuid="_12f8c04c-91d8-4c8a-b432-3350a9b417ec">subsection (4)</ref>, or</p>
      </content>
     </level>
     <level GUID="_63d520a5-6e99-4f28-9be8-8115dc296b16" class="para1" eId="sec_6__subsec_3__para_b">
      <num><?L 3-25?>(b)</num>
      <content>
       <p>is attributable to any neglect on the part of such a person, that person <?L 3-26?>(as well as the body corporate) is guilty of that offence and is liable <?L 3-27?>to be proceeded against and punished accordingly.</p>

      <p>The persons are—</p>
     </intro>

      <content>
       <p>a director, manager, secretary or other similar officer of the body;</p>
      </content>

      <num><?L 3-30?>(b)</num>
      <content>
       <p>any person who was purporting to act in such a capacity.</p>
      </content>

     <p><?L 3-32?>In this Act—</p>

      <p><def GUID="_4c059253-60d6-4818-bfb1-d311f0f8d45a" eId="sec_7__def_biocide" ukl:endQuote="”" ukl:startQuote="“"><?L 3-33?>biocide</def> means a substance with known or reasonably suspected <?L 3-34?>antimicrobial effects, but does not include edible substances or <?L 3-35?>commonly-used natural substances;</p>

     <content>
      <p><def GUID="_7308700a-4086-4495-b10d-e33a4d600a33" eId="sec_7__def_cosmeticproduct" ukl:endQuote="”" ukl:startQuote="“"><?L 3-36?>cosmetic product</def> means any substance or mixture intended to be placed <?L 3-37?>in contact with the various external parts of the human body <?L 3-38?>(epidermis, hair system, nails, lips and external genital organs) or with <?L 3-39?>the teeth and the mucous membranes of the oral cavity with a view <?L 3-40?>exclusively or mainly to cleaning them, perfuming them, changing <?L 4-1?>their appearance, protecting them, keeping them in good condition or <?L 4-2?>correcting body odours;</p>
