Make provision in relation to widening access to and participation in higher education; and for connected purposes.

B e it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Amendments to the Higher Education and Research Act 2017

(1)

The Higher Education and Research Act 2017 is amended as follows.

In section 12, after subsection (4) insert—


“(5)

Where this section applies to an institution, it applies to postgraduate
courses provided by that institution, notwithstanding that postgraduate
courses are not qualifying courses for the purposes of the fee limit
conditions in section 10.”

(3)

In section 32, in subsection (3)(a), after “students” insert “, and to improve
the participation of existing students,”.

(4)

In section 32, in subsection (3)(a), at the end insert “, or which are not
under-represented in higher education but whose members share a protected
characteristic in section 4 of the Equality Act 2010,”.

(5)

In section 32(5), omit paragraph (b).

2 Extent, commencement and short title

(1)

This Act extends to England and Wales only.

(2)

This Act comes into force on the day on which this Act is passed.

(3)

This Act may be cited as the Higher Education (Widening Access and
Participation) Act 2022.
